UNAIR NEWS – Being active in organizations and outside campus brought delights to Rizky Juliani Wulansari. That is her activity during studying in Faculty of Law, Universitas Airlangga (UNAIR). Being active in BEM FH UNAIR 2015, the Ministry of Students Advocacy and Public Policy brought her meaningful experiences. She was also included in Legal Aid Consultation Unit (UKBH) FH UNAIR to assist the society especially the poor which have legal issues such as land dispute, divorce, heritage settlement, and other problems.
“The busy schedule even motivated me even more to study hard and make achievements,” said Rizky who was named as the best S1 FH UNAIR graduate with GPA 3.86.
The title for her final assignment was “Perolehan Hak Atas Tanah yang Berasal Dari Tanah Negara Bekas Konversi Hak Barat (Acquisition of rights on state-owned land from the western right conversion”. She studied the topic because in the practical implementation, especially in judiciary institution or even the National Land Agency (BPN) itself does not really undertand the regulation on the acquisition of rights on state-owned land from the western right conversion.
“Oftenly cases related to that topic created a endless dispute. So it caused even more loss to many parties,” she said.
In her opinion, studying the law related to land rights is important as when Basic Agrarian Law (UUPA) was implemented in 1960, all lands, either from the customary law or the land rights originating from the western law that converted into the land rights in BAL. If the period of acquisition is overdue, then the land directly belongs to the state of usually termed as state land.
“At this point, legal connection between the right holder and the land is disconnected. But the former right holder still has civil right of the things on the land, such as plants, building on that land,” said Rizky. (*)
